The Gratuitous Promise

The Gratuitous Promise: not worth anything, but I'm making it anyway!.........My thoughts as a stay-at-home mom turned law student, who just passed the California bar exam.

If You Are Poor, Defame Away!

In commenting on a case where an indigent person walked around with signs claiming that her lawyer stole from her, the authors of my Remedies book note:

"Those who are completely judgment-proof may be undeterred, if they are sophisticated enough to understand their dubious advantage."

I guess the conclusion is that those people usually aren't smart enough to know what they can get away with, so we don't worry about it. Or perhaps the real reason is that someone with little or no means, especially in our society that places so much value on a person's financial worth, doesn't merit any listening-to, so what is the harm if a poor person makes defamatory comments?
